TERMS AND CONDITIONS FOR SAGINAW ONLINE AUCTION, LLC
Saginaw Online Auction and Bidder agree as follows:
1. Registration. You must register to get your Bidder Number. By registering you represent and warrant that you are 18 years of age. You also represent and warrant that all information that you provide is accurate. If any information that you provide is not true, then your bidding privileges will be revoked.
2. Condition of Auctioned Items. All Items are sold “As Is”. Saginaw Online Auction does not provide the descriptions of the auctioned items. Sellers provide the descriptions of auctioned items. Items are available for inspection and Saginaw Online Auction recommends that Bidders inspect the items in person. Failure to inspect the item in person, does not relieve Bidder of the obligation to purchase an item. Saginaw Online Auction makes every effort to provide accurate descriptions of items, please notify us if you notice any discrepancy in the description of an item that is for sale.
3. Reserves. Saginaw Online Auction may set reserves on auctioned items. Saginaw Online Auction reserves the right to reject any and all bids for any reason. Sellers or their agents may bid on their own items.
4. Buyer’s Premium. A Buyer’s premium of 10% will be add to all winning bids and will automatically be added to the winning bid and shown on the invoice.
5. Sales Tax. All sales are subject to appropriate state sales tax.
6. Payment. Bidder will pay Saginaw Online Auction after completion of the auction on any of the listed pick up days.
7. All Sales are Final. Every winning internet bid forms a contract and the winning Bidder is responsible for honoring that contract. Every legal remedy available may be used to insure payment by the winning Bidder.
8. Merchandise Pick Up. Bidder is responsible for picking up the items that are purchased from Saginaw Online Auction. If Bidder does not pick up their purchases on listed pick up days and times, then Saginaw Online Auction may charge storage fees, suspend the Bidder from using the site, and charge the Bidder in full for their purchases. If property is left at Saginaw Online Auction for 21 days, the property is considered abandoned and Saginaw Online Auction has the right to resell any property and keep any proceeds from the resale of the item as liquidated damages. Bidder may also be responsible for any costs associated with the storage and disposal of the abandoned purchases.
9. Damages to Property. Saginaw Online Auction shall not be responsible for any damage to items purchased, that occurs during the storage or loading or unloading of the items purchased, or any damages to any vehicles or trailers.
10. Right to Terminate Purchase. If Saginaw Online Auction for any reason is unable to complete the sale of any purchase to Bidder or provide such purchase free and clear of liens, even if the Bidder was given notice that Bidder was the winning bidder, Bidder agrees that Saginaw Online Auction may terminate the purchase, in which case Saginaw Online Auction’s only liability shall be the return of the amount paid by Bidder. Saginaw Online Auction can also terminate the purchase if a missed reserve or minimum price or the seller’s unwillingness to release or deliver the item to Saginaw Online Auction. Saginaw Online Auction also reserves the right to settle all disputes that may arise between bidders, sellers or Saginaw Online Auction. In the event that an auctioned item varies from the written description or photograph of the auctioned item, it is at the discretion of Saginaw Online Auction as to whether or not the sale will be completed or terminated. Saginaw Online Auction may also suspend bidding for any reason on an individual item or the entire auction.
11. Revocation of Bidder Number. Saginaw Online Auction reserves the right to prohibit any Bidder from using the site for any reason, without notice.
12. Indemnification. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless Saginaw Online Auction and its managers, owners, affiliates, subsidiaries, directors, agents, representatives and employees, and each seller, from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses, including reasonable attorneys’ fees and expenses related to, arising from or associated with Bidder, Bidder’s agents or representatives, use of this site, including but not limited to personal injuries or property damage incurred on Saginaw Online Auction’s premises or during removal and transport of any auction item, or arising out of, based upon, or resulting from any breach or violation by Bidder of any of the Terms of Conditions or part of this website, user agreement or any use by Bidder of this website or as a result of a dispute with another Bidder.
13. Limit of Liability. Saginaw Online Auction’s liability to Bidder is limited to the purchase price paid by Bidder. Saginaw Online Auction is not responsible for any interruption in service, errors or omissions, caused by any means and does not guarantee continuous uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Saginaw Online Auction in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any items that were affected by any malfunction or for any other reason. Saginaw Online Auction is not responsible for errors in descriptions of the auctioned items.
14. Michigan Law. By using this site, the Terms and Conditions and all other contracts shall be governed in all respects, whether as to validity, construction, capacity, performance or otherwise, by the laws of the State of Michigan. By using this site, Bidder is consenting to the jurisdiction in Saginaw County, Michigan.
By Bidding on this site you agree to the Terms and Conditions and you are entering into a legally binding contract.
